Introducci\u00f3n: \u00bfQu\u00e9 es la transferencia de buque a buque?<\/h2>\n\n\n\n<p><strong><a href=\"https:\/\/en.wikipedia.org\/wiki\/Ship-to-ship_cargo_transfer\">Transferencia de buque a buque (STS)<\/a><\/strong> es el proceso de trasladar carga -generalmente l\u00edquidos a granel, como petr\u00f3leo crudo, GNL o productos qu\u00edmicos- entre dos buques situados uno al lado del otro en el mar o en un puerto. Suele utilizarse para operaciones de aligeramiento, evitar la congesti\u00f3n portuaria, realizar descargas de emergencia o transferir carga entre buques con pabellones diferentes.<\/p>\n\n\n\n<p>Pero, \u00bfes legal este tipo de operaci\u00f3n? La respuesta es s\u00ed, pero s\u00f3lo cuando se hace seg\u00fan las normas. La legalidad depende del cumplimiento del Derecho mar\u00edtimo internacional, las normativas nacionales y el uso adecuado de los equipos.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">2. \u00bfEs legal la transferencia STS?<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">2.1 En virtud del Derecho internacional (OMI y MARPOL)<\/h3>\n\n\n\n<p>S\u00ed, las transferencias STS son legales <strong>si se hace conforme a las normas internacionales<\/strong>. En <strong>Organizaci\u00f3n Mar\u00edtima Internacional (OMI)<\/strong>a trav\u00e9s del <strong>Convenio MARPOL Anexo I, Cap\u00edtulo 8<\/strong>exige que los petroleros de 150 toneladas brutas o m\u00e1s sigan un programa aprobado por el gobierno. <strong>Plan de operaciones STS<\/strong>. Incluye procedimientos de prevenci\u00f3n de la contaminaci\u00f3n, gesti\u00f3n de riesgos, responsabilidades del personal y documentaci\u00f3n detallada.<\/p>\n\n\n\n<p>Estas normas entraron en vigor en <strong>Enero de 2011<\/strong>que hace obligatorio su cumplimiento para los buques con pabell\u00f3n que realicen operaciones STS con cargamentos de petr\u00f3leo.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2.2 Normativa nacional (por ejemplo, Estados Unidos)<\/h3>\n\n\n\n<p>Pa\u00edses como el <strong>Estados Unidos<\/strong> tienen normativas m\u00e1s estrictas. En <strong>33 CFR Parte 156 Subparte D<\/strong>...la Guardia Costera de EE.UU. exige..:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Aviso previo de al menos 48 horas antes de que se produzca cualquier transferencia STS en aguas estadounidenses.<\/li>\n\n\n\n<li>Informes detallados sobre los buques implicados, el tipo de carga, la ubicaci\u00f3n, la hora y las credenciales del operador.<\/li>\n\n\n\n<li>Aprobaci\u00f3n obligatoria del plan de transferencia.<\/li>\n<\/ul>\n\n\n\n<p>El incumplimiento puede dar lugar a multas, inmovilizaci\u00f3n del buque o incluso cargos penales.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2.3 STS para productos qu\u00edmicos y GNL<\/h3>\n\n\n\n<p>Transferencias STS de <strong>productos qu\u00edmicos, GLP o GNL<\/strong> tambi\u00e9n est\u00e1n permitidos, pero no se contemplan espec\u00edficamente en los anexos II o III de MARPOL. En su lugar, deben seguir las directrices del <strong>C\u00f3digo Internacional de Gesti\u00f3n de la Seguridad (ISM)<\/strong>y muchos Estados de abanderamiento o autoridades portuarias exigen que los transbordos de GNL se ajusten a las siguientes normas <strong>Directrices OCIMF\/ICS<\/strong>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">3. Por qu\u00e9 es importante el cumplimiento<\/h2>\n\n\n\n<p>El estatuto jur\u00eddico de las transferencias STS depende de una estricta <strong>conformidad<\/strong>. Equipos utilizados en las operaciones STS<\/h2>\n\n\n\n<p>Un equipamiento adecuado es clave para que las operaciones STS sean seguras y legales. Veamos qu\u00e9 se necesita:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><thead><tr><th>Equipamiento<\/th><th>Prop\u00f3sito<\/th><\/tr><\/thead><tbody><tr><td><strong><a href=\"https:\/\/www.sunhelmmarine.com\/es\/floating-pneumatic-fenders\/pneumatic-fender\/\">Defensas Neum\u00e1ticas<\/a><\/strong><\/td><td>Son esenciales para amortiguar el espacio entre dos embarcaciones. Absorben la energ\u00eda durante el contacto y evitan da\u00f1os en el casco. Deben cumplir la norma ISO 17357-1:2014.<\/td><\/tr><tr><td><strong>Defensas secundarias \/ Alfombrillas de seguridad<\/strong><\/td><td>Proporcionan una protecci\u00f3n adicional del casco en las zonas no cubiertas por las defensas primarias.<\/td><\/tr><tr><td><strong>L\u00edneas y aparejos de amarre<\/strong><\/td><td>Se utiliza para asegurar las naves entre s\u00ed. Debe seguir las recomendaciones de OCIMF MEG4.<\/td><\/tr><tr><td><strong>Mangueras de transferencia de carga<\/strong><\/td><td>Deben ser compatibles con el tipo de carga (petr\u00f3leo, GNL, etc.) y disponer de acoplamientos de ruptura para evitar derrames en caso de emergencia.<\/td><\/tr><tr><td><strong>Kits de respuesta ante vertidos de petr\u00f3leo<\/strong><\/td><td>Incluidas barreras de contenci\u00f3n, espumaderas y almohadillas absorbentes, necesarias en el lugar para hacer frente a cualquier vertido accidental.<\/td><\/tr><tr><td><strong>Detectores de gas y v\u00e1lvulas de seguridad<\/strong><\/td><td>Especialmente importante en operaciones con GNL\/GLP para detectar fugas de gas inflamable.<\/td><\/tr><tr><td><strong>Sistemas de comunicaci\u00f3n<\/strong><\/td><td>Radios o comunicaciones por sat\u00e9lite para mantener sincronizados los buques y los equipos de apoyo.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<p>Entre todos ellos, <strong><a href=\"https:\/\/www.sunhelmmarine.com\/es\/floating-pneumatic-fenders\/pneumatic-fender\/\">defensas neum\u00e1ticas<\/a><\/strong> desempe\u00f1an un papel fundamental. Sin ellas, el contacto entre cascos durante la transferencia STS podr\u00eda causar graves da\u00f1os estructurales o incluso romper la contenci\u00f3n, lo que podr\u00eda provocar vertidos de petr\u00f3leo y problemas legales.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">5. Gesti\u00f3n de riesgos y personal<\/h2>\n\n\n\n<p>Un requisito legal clave es contar con supervisores cualificados. Las directrices internacionales exigen un <strong>POAC (Persona en Control Consultivo General)<\/strong> o <strong>Patr\u00f3n de amarre<\/strong> a bordo para gestionar la transferencia.<\/p>\n\n\n\n<p>Las operaciones deben estar respaldadas por:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Un escrito <strong>Plan Operativo Conjunto (POC)<\/strong>.<\/li>\n\n\n\n<li>A fondo <strong>evaluaci\u00f3n de riesgos<\/strong>.<\/li>\n\n\n\n<li>Claro <strong>protocolos de parada de emergencia<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>Todos los implicados deben recibir formaci\u00f3n, y las embarcaciones deben realizar simulacros para prepararse ante accidentes como el fallo de una manguera, el oleaje repentino o los cambios de posici\u00f3n.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">6. Informes y documentaci\u00f3n<\/h2>\n\n\n\n<p>Si opera en aguas reguladas (por ejemplo, cerca de EE.UU.), la ley exige:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Aviso previo<\/strong> de operaciones (por ejemplo, 48 horas para los guardacostas estadounidenses).<\/li>\n\n\n\n<li><strong>Documentaci\u00f3n precisa<\/strong> en el Libro de Registro de Petr\u00f3leo del barco.<\/li>\n\n\n\n<li><strong>Conservaci\u00f3n de todos los registros durante un m\u00e1ximo de 3 a\u00f1os<\/strong>.<\/li>\n\n\n\n<li>Notificaci\u00f3n inmediata de cualquier vertido o desviaci\u00f3n.<\/li>\n<\/ul>\n\n\n\n<p>No documentar correctamente puede convertir una operaci\u00f3n legal en un delito punible.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">7. Riesgos jur\u00eddicos comunes en las transferencias STS<\/h2>\n\n\n\n<p>Aunque la transferencia STS sea \"t\u00e9cnicamente legal\", hay algunos errores que pueden hacerla ilegal:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Utilizando <strong>defensas no conformes<\/strong> (por ejemplo, sin certificaci\u00f3n ISO).<\/li>\n\n\n\n<li><strong>Sin plan CTS aprobado<\/strong> a bordo.<\/li>\n\n\n\n<li><strong>Falta de notificaci\u00f3n a las autoridades<\/strong>.<\/li>\n\n\n\n<li><strong>Personal no cualificado<\/strong> dirigiendo la operaci\u00f3n.<\/li>\n\n\n\n<li><strong>Kits de respuesta a vertidos desaparecidos o caducados<\/strong>.<\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\">8. Conclusi\u00f3n<\/h2>\n\n\n\n<p>S\u00ed, <strong>las transferencias entre buques son legales<\/strong>-pero s\u00f3lo cuando se realiza en el marco jur\u00eddico y t\u00e9cnico adecuado.<\/p>\n\n\n\n<p>Para cumplir la normativa:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Siga <strong>Anexo I de MARPOL<\/strong> y las leyes locales.<\/li>\n\n\n\n<li>Utilice <strong><a href=\"https:\/\/www.iso.org\/standard\/59873.html\">Equipamiento conforme a las normas ISO<\/a><\/strong>especialmente <strong><a href=\"https:\/\/www.sunhelmmarine.com\/es\/floating-pneumatic-fenders\/pneumatic-fender\/\">defensas neum\u00e1ticas<\/a><\/strong>.<\/li>\n\n\n\n<li>Contratar proveedores de servicios STS experimentados y POAC certificados.<\/li>\n\n\n\n<li>Informar, documentar y prepararse para emergencias.<\/li>\n<\/ul>\n\n\n\n<p>Si opera en zonas STS -especialmente rutas de petr\u00f3leo y gas- aseg\u00farese de que su equipo, tripulaci\u00f3n y planes est\u00e1n <strong>listo y legal<\/strong>.
